Cases Description

In this matter, the Plaintiff seeks declaratory and injunctive relief from Tenn. Code Ann. § 38-8-312(q)(1)(D), which denies individuals of a right to an investigation into complaints of police misconduct if that same individual has initiated, threatened, or given notice of the intent to initiate litigation against the local police agency or its employees.  Plaintiff alleges the statute violates her rights to freedom of speech and freedom of petition under the First Amendment to the United States Constitution as well as Tennessee Constitution art. I, sections 19 and 23.
