Under the supervision of the Deputy Chief Disciplinary Counsel – Litigation and the Chief Disciplinary Counsel, Disciplinary Counsel represents the Board of Professional Responsibility in litigating attorney disciplinary matters before hearing panels and handling appeals before special judges in trial courts and the Tennessee Supreme Court. Candidates are expected to have knowledge of appellate procedures, with trial court experience preferred. The Disciplinary Counsel prepares and presents continuing legal education presentations.
DUTIES AND RESPONSIBILITES:
- Obtain and provide discovery on behalf of the Board of Professional Responsibility (BPR) regarding the prosecution of formal charges against an attorney;
- Draft pleadings and represent the BPR in prosecuting attorneys at disciplinary hearings before hearing panels;
- Research, brief and argue on behalf of the BPR in appellate proceedings before special judges in trial courts and the Tennessee Supreme Court;
- Serve on the Charging Committee reviewing disciplinary recommendations to the BPR;
- Prepare reports and present recommendations to the BPR and Tennessee Lawyers’ Fund for Client Protection at quarterly meetings;
- Represent the BPR by speaking at continuing legal education seminars; law schools, bar associations and other local and national organizations;
- Other duties as assigned.
MINIMUM EDUCATION/EXPERIENCE: Attorney licensed in Tennessee with a minimum of five (5) years’ experience in the practice of law. While appellate work is the focus, trial experience is needed. Practice before the Tennessee Supreme Court preferred.
SKILLS AND ABILITY: Excellent written and oral communication skills and ability to handle difficult people or highly emotional situations with diplomacy and efficiency.
