This ninety-minute session will focus on the ethical challenges that attorneys navigate when representing parents with disabilities and communication challenges in dependency and neglect proceedings in juvenile court. The session will focus on the professional responsibility to be competent, diligent, and effective communicators with parent-clients. Against this backdrop, this session will provide information on legal protections for litigant parents with disabilities under the Americans with Disabilities Act and Section 504 of the Rehabilitation Act, resources to support effective communication at hearing and in hearing preparation, and how to navigate diminished capacity in clients with disabilities. The session will also provide opportunities for interactive application of representation skills and Motivational Interviewing to support the engagement of the parent-client with communication challenges and disabilities.
