This presentation will focus on the requirement of mediator impartiality as prescribed in Tennessee Supreme Court Rule 31, the Model Standards of Conduct for Mediators (2005), and the Model Standards of Practice for Family and Divorce Mediation (2001). The presenter will review the standards and their definitions of "impartial." The attendees will then be asked to actively participate as the presenter offers various scenarios that implicate the impartiality standard and that also raise questions regarding the relationships between impartiality and other mediation principles and requirements, such as self-determination, fairness, informed decision-making, and, maintenance of a balanced process. The presentation will conclude with a summary of actions mediators can take to assist in meeting the impartiality requirement. There will be six pages of handouts.
The presenter is Charles L. Young, B.A, M.A., J.D. Mr. Young has extensive legal and mediation experience, having served as legal counsel for the Tennessee Valley Authority, Rule 31 mediator
(currently inactive), volunteer mediator with the Knoxville Community Mediation Center, and professor of English and Business Law at the college level.
