W 401 Broadway LLC Plaintiff filed a motion for judgment on the pleadings, asking the Court for an early ruling on the terms of the parties’ lease, in which Plaintiff is the tenant and Defendant is the landlord. Plaintiff-Tenant used the premises as a restaurant until a fire partially destroyed the premises, and Plaintiff-Tenant now seeks to restore the premises for use as a honkytonk instead of a restaurant. The lease contemplated a fire event and set out provisions that are contingent on whether the fire destroyed more or less than 50% of the premises. The parties dispute the percentage of destruction and whether Plaintiff-Tenant may restore the premises to a condition inconsistent with the condition prior to the fire. While there are some ambiguities in the lease, the paragraphs regarding the parties’ recourse after fire damage, regardless of the percent of destruction, state that the premises is to be restored “to the condition existing prior to the occurrence of the fire or other peril.” Therefore, Plaintiff-Tenant’s motion for judgment on the pleadings is denied. Graby also argued that Newell failed to properly join the corporation because Newell listed “Floored, Inc.” instead of “Floored Inc” – which is the proper name of the company.
