The petitioner, Preston Rucker, seeking post-conviction relief, argued that trial/appellate counsel was ineffective because he failed to call a certain witness to contradict the victim's testimony and failed to request a jury instruction regarding the kidnapping charge against the petitioner. Following an evidentiary hearing, the post-conviction court concluded that the petitioner failed to show that counsel was ineffective.
